Update - the cops won't press charges cause they are both saying he never touched my husband. Also, because my husband does not fear for his life, they will not pursue the uttering threats either. To top it off, step-dad could charge my husband with trespassing!!! because he was told to get off the property!!!
He can pursue charges himself in court.
